The kingdom that monetized telling the world "no"
Tonga's claim to data-haven status is older than the industry it shelters. In the early 1990s the kingdom delegated its .to ccTLD to a private operator that marketed it, openly, to publishers whose content could not survive at home. The experiment produced a legal posture that survives today: Tongan law contains no notice-and-takedown procedure for copyright, no administrative body that can order content offline, and no statute requiring hosting providers to retain customer data.
What Tonga does have is ordinary courts and a Copyright Act from 2002 with almost no enforcement history. A foreign complainant must engage Tongan counsel and win an order from the Supreme Court of Tonga in Nuku'alofa. We have never seen a foreign civil claim reach that bar. US DMCA notices are, as everywhere outside the United States, legally inert — there is no Tongan DMCA for them to operate under.
Tonga is also genuinely off the diplomatic map: no membership in the 5/9/14-eyes alliances, no mutual-assistance shortcuts of consequence for civil claims, and an ocean of distance from every major content industry. Because the data-haven idea was tested there first. Tonga's .to registry was marketed globally in the 1990s as an escape route for content that could not survive its home jurisdiction, and the legal posture stuck: no copyright takedown procedure, no retention mandate, no surveillance-alliance membership. It remains the purest geography in our lineup for content that simply must stay up.
